User Agreement - instibuzz

Your use of Goldwin's products, software, services and web sites (referred to collectively as the "Services" in this document and excluding any services provided to you by Goldwin under a separate written agreement) is subject to the terms of a legal agreement between you and Goldwin. "Goldwin" means Goldwin ITES Pvt Ltd, whose principal place of business is at 1928, Gorakhpur Jabalpur. This document explains how the agreement is made up, and sets out some of the terms of that agreement.

Unless otherwise agreed in writing with Goldwin, your agreement with Goldwin will always include, at a minimum, the terms and conditions set out in this document. These are referred to below as the "Terms".

Your agreement with Goldwin will also include the terms of any Legal Notices applicable to the Services, in addition to the Terms. All of these are referred to below as the "Additional Terms". Where Additional Terms apply to a Service, these will be accessible for you to read either within, or through your use of, that Service.

The Terms, together with the Additional Terms, form a legally binding agreement between you and Goldwin in relation to your use of the Services. It is important that you take the time to read them carefully. Collectively, this legal agreement is referred to below as the "Terms".

If there is any contradiction between what the Additional Terms say and what the Terms say, then the Additional Terms shall take precedence in relation to that Service.

By using the instibuzz community (currently located at http://www.instibuzz.com) you agree to be bound by these terms and conditions, whether or not you register as a member of the instibuzz community.

Instibuzz does not hold itself responsible for the damage / loss / safety of any of the transactions going on between individual users of this site.

www.instibuzz.com (the "Site") also referred to as instibuzz in this document reserves the right at its discretion to change or modify these terms and conditions at any time, effective immediately upon notification on this web site.

You must read, agree with and accept all of the terms and conditions contained in this User Agreement and instibuzz Privacy Policy before you may become a member of instibuzz.com

Eligibility:
You must be 18 years or older to use the instibuzz.com service. By registering for the instibuzz.com service, you warrant that you are 18 years or older and that you have the capacity to understand, agree to, and comply with these terms and conditions.

Membership:
You must provide true, accurate and complete registration information to be a instibuzz member. As part of the registration process you will be asked to create a username and password, and you will be responsible for all the activities that will go on in your account.

In order to become a registered member, you must first agree to the Terms and conditions in the User Agreement and the Instibuzz Privacy policy. You may not use some of the services of instibuzz.com (the "Site"), if you do not accept the Terms and Conditions and the Privacy Policy of the Site.

You must read, agree with and accept all of the terms and conditions contained in this User Agreement and Instibuzz Privacy Policy before you may become a member of Instibuzz.com

www.instibuzz.com (the "Site") reserves the right at its discretion to change or modify these terms and conditions at any time, effective immediately upon notification on this web site.

As a member of instibuzz.com, you can create a profile that may include personal information, such as you age, gender, profession, interests and hobbies. You may also include other contents, such as photo, name of institution / organization / company. You can choose if you wish to make some information visible to other instibuzz.com members.

Our servers automatically record information when you visit our website or use some of our services, which includes the IP address, the URL, and the date and time of access, among a few others.

Under no circumstances will we alter your personal information and the data you have entered unless we have to delete an account because of non compliance of terms and conditions.

If you use this Site, you are responsible for maintaining the confidentiality of your account and Password and you agree to accept responsibility for all activities that occur under your account or Password.

You agree not to access (or attempt to access) the Site through any automated means (including use of scripts or web crawlers) and shall ensure that you comply with the instructions set out in any robots.txt file present on the Site.

Currently the site does not charge any fee for membership and other services on the Site.

Second hand stuff (the "Items") means accessories/ mobiles/ any other good of normal usage which people would like to sell. The following categories are defined now,
Mobiles
Books
Two wheelers/ four wheelers


If you find that your item does not fall in any of these, you may post it in "Other goods" taking into account that you cannot list following Items on the Site

1. Counterfeit or stolen.
2. Which infringe any third party's intellectual property, trade secret or other proprietary rights or rights of publicity or privacy.
3. Religious Items which is likely to affect the religious sentiments of any person.
4. Containing pornographic materials and any objectionable material.
5. Used cellular phone SIM Cards.
6. Pornographic videos, picture, text, content and pornographic material in any other form.
7. Content not suitable for minors.

Insitbuzz.com (the "Site") is a channel of communication through which users can reach a larger number of people to buy and sell Items, look for accommodations, display notices in college campuses, company premises, any city. Instibuzz is only providing a platform for communication and it is agreed that the contract for sale of Items shall be a strictly bipartite contract between the seller and the buyer. The same applies to accommodation and other transactions that take place through the site. Instibuzz is not and cannot be a party to or control in any manner any transaction between two Users of the Site.

Instibuzz is not responsible for any non-performance or breach of any contract entered into between Users. Instibuzz shall not and is not required to mediate or resolve any dispute or disagreement between Users.

Instibuzz does not make any warranty of quality, availability and worth of the Items proposed to be sold or purchased on the Site.

Instibuzz does not make any warranty of identity of any of its Users. You are advised to independently verify identity of any particular User that you choose to deal with on the Site.

We use your information as described in the Privacy Policy

Instibuzz.com may terminate this agreement and terminate your membership at any time without notice for any reason.


Buying
If you are the purchaser for any Items and your purchase is accepted by the seller, you are obligated to complete the transaction with the seller. Right now the Site is not providing any platform to exchange money between seller and buyer. It is buyer's responsibility to collect the Items from seller and handover the money to him. Instibuzz.com will not be responsible for any money dispute, or Items quality dispute between buyer and seller.

Selling
As a registered member, you may list Items for sale on the Site. You must ensure that the listed Items do not infringe upon the intellectual property, trade secret or other proprietary rights or rights of publicity or privacy rights of third parties. Listings may only include text descriptions that describe your Items for sale. Right now the Site is not providing any platform to exchange money between seller and buyer. It would be seller's personal responsibility to contact the Buyer and sell the Items and collect the money from him. Instibuzz will not contact the buyer and will not be responsible for any money dispute, or Items quality dispute between seller and buyer. The listing description of the Items must not be misleading. The listing description cannot contain any viruses, Trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, harmfully interfere with, surreptitiously intercept or expropriate any system, data or personal information.

Share a ride:
As a registered member, you may give or take a lift(ride) from the destination and source of your choice for one time or regularly by an individual on the Site. Listings may only include text descriptions that describe your options for ride. It would be your personal responsibility to contact the individual interested in sharing the ride, and collect the money from him or her. instibuzz will not contact the interested person and will not be responsible for any money dispute, or ride quality dispute between you and interested person. The listing description of the ride must not be misleading. The listing description cannot contain any viruses, Trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, harmfully interfere with, surreptitiously intercept or expropriate any system, data or personal information.


Following are some tips to ensure the safety of ride, users are advised to follow these as the safety and quality of ride would be a solely bipartite contract and this site won't have any control upon the users in any respect

• Meet the person you are considering for travel in a public place and discuss about the trip and safety while driving to reach an agreement.
• Exchange emergency contact information before you start the trip - at least one phone number for a family member or close friend and important medical information you may have.
• To establish credibility and ensuring safety, verify the driver's licenses or exchange photos of each other.
• If required, ask for personal references and call them to enquire the trustworthiness of the driver.

Accommodation:
As a registered member, you may list renting or sharing an apartment, a house or any other place suitable for stay ("accommodation") permanently or temporarily by an individual on the Site. You must ensure that the listed accommodation listed do not infringe upon the intellectual property, trade secret or other proprietary rights or rights of publicity or privacy rights of third parties. Listings may only include text descriptions that describe your accommodation for rent or share. It would be your personal responsibility to contact the individual interested in renting or sharing your accommodation, rent or share the accommodation to him or her and collect the money from him or her. instibuzz will not contact the interested person and will not be responsible for any money dispute, or accommodation quality dispute between you and interested person. The listing description of the accommodation must not be misleading. The listing description cannot contain any viruses, Trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, harmfully interfere with, surreptitiously intercept or expropriate any system, data or personal information. You may also list renting or sharing an apartment , a house or any other place suitable for stay ("accommodation") permanently or temporarily by an individual that you would like to share or avail for rent on the Site
Following are some tips to ensure the safety during your accommodation, users are advised to follow these as the safety and comfort of accommodation would be a solely bipartite contract and this site won't have any control upon the users in any respect

• Meet the person you are considering for accommodation in a public place and discuss about the rent, quality of stay, personal habits to reach an agreement.
• Exchange emergency contact information before you share the accommodation - at least one phone number for a family member or close friend and important medical information you may have.
• If required, ask for personal references and call them to enquire the trustworthiness of your roommate.

General Discussion Forums:

You assume the responsibility of the content you post in any discussion forum. The listing description of the discussion must not be misleading. The listing description cannot contain any viruses, Trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, harmfully interfere with, surreptitiously intercept or expropriate any system, data or personal information.

You may not use this service for any illegal or unauthorized or harmful purpose. Users from anywhere agree to comply with all respective local laws regarding online conduct and content, including laws that govern the export of data from any region. You are solely responsible for your conduct, and the content that you submit, post and display on the instibuzz.com. We may remove content that we in our sole discretion determine as unlawful, fraudulent, threatening, obscene or anything otherwise that is objectionable or infringes on the intellectual property of any other individual or violates these terms and conditions.

Other examples of illegal or unauthorized uses include, but are not limited to:

• modifying, adapting, translating, or reverse engineering any portion of the instibuzz.com service
• removing any copyright, trademark contained on the instibuzz.com service
• using any robot, spider, site search/retrieval application, or other device to retrieve or reconstruct any portion or the service
• collecting any information about other registered members (including usernames and/or email addresses) for unauthorized purposes
• creating or transmitting unwanted electronic communications such as "spam", or chain letters to other registered members
• submitting Materials of any third party without such third party's prior lawful consent
• submitting content that falsely imply that such content is sponsored or endorsed by instibuzz.com
• transmitting any viruses, worms, defects, Trojan horses or other items of a destructive nature
• Submitting content that are unlawful or promote or encourage illegal activity.

Disclaimer of Warranties & Limitation of Liability


1. All the content, information, discussions, postings or response to postings found on the service are provided on an "as is" basis without warranties of any kind, either express or implied, including, but not limited to , warranties of title or implied warranties or merchantability of fitness for a particular purpose

2. you expressly agree that the use of service is at your sole risk. Neither instibuzz, its affiliates, nor any of its employees, agents, third party content providers, or licensors warrant the service will be uninterrupted or free of errors nor do they make any warranty as to the results that may be obtained from the use of the service, or as to the accuracy, reliability, completeness or contents of any item, accommodation, ride , discussion or any other posting or the responses to posting found on the Service, any merchandize or services provided through the Service, or any links to other sites made available on the service

3. instibuzz( or any of its parents, subsidiaries, affiliates, employees, agents, third party content providers, or licensors, and their respective directors, officers, employees, and agents) , in no event would be liable for any direct , indirect, incidental, special or consequential damages that result from the use of, or the inability to use, any content, information, discussions, postings, or response to postings

Items list, prices, availability and any other information are subject to change at any time without notice. instibuzz.com may change, suspend, or eliminate all or any aspect of this web site at any time, including the availability of any feature, database, or content, without prior notice or liability.
